Abstract

This chapter examines First Amendment challenges in public schools, focusing on free speech and religious expression. As school leaders navigate a volatile legal landscape, understanding key cases like Tinker v. Des Moines (1969) and Mahanoy Area School District v. B.L. (2021) is essential for safeguarding student rights. The chapter also presents original research involving over 700 principal candidates, revealing a gap between their recognition of First Amendment issues—particularly regarding social media and religious expression—and their preparedness to address these challenges. It advocates for a comprehensive overhaul of principal preparation curricula to include updated legal content, practical applications, and ongoing professional development, ensuring future leaders can effectively balance individual rights while maintaining an effective educational environment.
