Abstract

One of the critical features of automated biometric recognition applications is that, unlike traditional security systems, they do not solely rely on memory or knowledge-based features like passwords and thus provide protection and identification of an enhanced form. Bio-metric recognition systems instead weigh on pattern matching. They collect biological data from an individual using sensors and match the extracted discriminatory features from the input received with the already existing data in the system. Unique identification projects do not solely pose a danger from the side of the government authorities alone, and private players have also entered the game of misusing sensitive information of the users. It would thus not be wrong to state that privacy has indeed become a commodity to be sold off for monetary gains. However, the concept of “privacy” is a contentious domain, and debates pertaining to its scope continue.

Introduction And Evolution Of Biometric Data System

The post-modern world has witnessed a surge in innovative and novel technological advancements across the globe. In this fast-changing technology-savvy world, everything is available at the click of our mouse. However, this ceaseless changing technology also causes incomprehensible problems for the people who are placed on the other side of the digital divide. One of the technological boons of the Contemporary world is the introduction of Biometric data in daily mundane life. It has found a due place in our lives as the ultimate purpose of emerging technology is to make our lives better. Lately, this technology has been used by the government, private offices, and other organizations.

Not only this, in February 2015, the government of India required all the people to provide their information on the Biometric system for applying for a passport. The trajectory of this highly appreciated technology emanated in India after LPG in the 1990s as many Multinational Companies and Transnational Corporations came in our country with a new set of labour-intensive technology and humungous capital (Sharma, 2006). Fortunately, the domestic companies also started following the newly recognized technology so as to be at par with their foreign contemporaries. Therefore, information stored in a Biometric system has become quite a norm these days in India. Developed nations like the USA, UK, Australia, New Zealand have been practicing this technique since the 1950s. However, it is heartening to note that even Developing nations follow the ‘good practices’ in this modern technological setup.

Conversely, the present Chapter shall also delve into the detailed nuances of this technology and the problems emanating out of the same. It shall be not be discussing the rosy picture only, instead it shall also look into the issues of Privacy which usually become the cause of concern when it comes to Biometric data. The Chapter shall also delve into the legal imperatives in India, tackling the said issue of Intertwinement between the Right to Privacy and the use and application of Biometric Data.
